UPAYA MENGATASI OVERCROWDED WARGA BINAAN DI LEMBAGA PEMASYARAKATAN KELAS II A PURWOKERTO BERDASARKAN PARADIGMA HUKUM PROGREIF

This research, entitled "Efforts to Address Inmate Overcrowding in the Class II
A Purwokerto Penitentiary Based on the Progressive Legal Paradigm," aims to
identify the efforts and obstacles in overcoming inmate overcrowding at the institution
using a progressive legal approach.
Employing empirical legal techniques and a mixed-methods approach with a
concurrent triangulation design, the study shows that current overcrowding mitigation
efforts have been implemented well. These include conditional leave, parole, pre-
release leave, assimilation, and remission. These efforts are further supported by the
new Criminal Code (KUHP) No. 1 of 2023, which introduces alternative non-custodial
penalties such as detention, supervision, fines, and community service.
However, overcrowding persists at a rate of 24.59 percent, posing a major
challenge to the Ministry of Immigration and Corrections' 13 acceleration programs.
The primary obstacles include regulatory disharmony among law enforcement
agencies, limited human resources in corrections, and dualism in narcotics
regulations. Ultimately, this research aims to provide breakthroughs to effectively
reduce prison overcrowding.
